The Court has preliminarily determined that the following persons are members of the Settlement Class:

All persons in the United States who used an automated teller machine ("ATM") card issued by a financial institution other than Chase to withdraw cash from an ATM operated by Chase and were charged a fee by Chase for use of the ATM between August 9, 2005, and September 10, 2006.

The Class Representatives and the Defendant agreed to a settlement. The Class Representatives and their respective attorneys believe the Settlement is best for all Settlement Class Members.

THE PARTIES HAVE AGREED TO THE SETTLEMENT GENERALLY DESCRIBED BELOW:

Class Members may receive up to the full amount of withdrawal fees paid at a Chase ATM (usually $1.50 or $2.00 per withdrawal). Chase will pay up to a total of $2.1 million to cover all claims and settlement costs.
